What is Right Free Music?

Right Free music is music where there are no invoices and bills for usage of the music by Collective Societies. In other words you may listen to music in public places without the financial downside. We all know there is a substantial financial downside for the usage of music. There are several parties that offer you right free music but unfortunately there are some matters to take into consideration.

Oriental music should be free of rights, al least that is what they say. Some asian countries have not adapted the “Rome Convention” and there for music from that region should be free of rights. This is not entirely true. When and if an author is a member of a Collective Society his or her music is not free of rights at all. If the “Rome Convention” is not adapted by a specific country is does not mean that all invoices will disappear. In general you have to pay two separate collective societies. One is for public performance of rights belonging to authors and music publishers and the second invoice is for the public performance of rights that belong to record companies and performers. Music from Asia sometimes is liberated from the second portion of rights but that does not mean that the first portion can be deleted automatically. On top of this take in consideration that most Asian countries will adapt to the “Rome Convention” and therefor the music from that area will no longer be free of rights at all, leaving you with a substantial financial debacle.

Creative Commons

Another alleged Right Free music program is Creative Commons. They claim that music offered under their license is free of rights, what they do not say is that you may not use it for commercial purposes. Another restriction is that you cannot control where the music is used for in the past and even worse where it will be used for in the future. An author of a song may become a member of a Collective Society and put up all its music for commercial use. If this is the case all its music is no longer free of rights and you will get a bill for the use of it. How are you going to keep track of what music is free or rights and what is not? This simply is not a solution at all, but a very dangerous undertaking that you should avoid at all costs.

Other Music Services

There are lots of different music services in the field. Other parties may offer you music via internet radio, podcasts, forward store systems and so on. None of them will point out to you that you will receive a bill for public performance of music from a Collective Society. There are even parties that do not pay any form of contribution to a Collective Society them selves and they either disappear from the market without any notice or are put out of business by a court order. Again you as a customer are left with the problems and no certainty what so ever about your music.

Other Right Free Music

Several professional music suppliers offer you Right Free music as a service too. All of them claim to have a catalogue that supposedly is free of rights. However non of them will put that in writing and they have a very good reason for that too. Since they do not own the catalogue they can never guarantee that the entire catalogue is free of rights and it will stay that way. Again, only one author will have to become a member of a Collective Society and as a result the entire catalogue is no longer free of rights. Result: you will receive an invoice from a Collective Society and you are back to square one.

Another point to take into consideration is that 99% of the existing Right Free catalogues are static. Meaning it is an old catalogue and no new songs are added to it. This ultimately will lead to a very “boring” music experience, you will hear the same songs over and over again. You have bought an inferior product for too high a price.

Turnover Collective Societies

Buma Stemra (authors rights)

Below you will find some numbers and illustrations taken from Buma Stemra and Sena. These are the Collective Societies of the Netherlands. The illustrations are directly taken from their annual reports.

A massive 29.9% of the total turnover is generated from collection of public performance. A similar or even higher amount of income is generated by your local Collective Society. We will put up some more diagrams and numbers of other Collective Societies soon.
